Insurance Issues Facing Chinese Drywall Homeowners

Many victims of Chinese drywall are being denied claims filed on their homeowners’ insurance. This is what happened to Lucille Bourdon, who built a house in Covington in 2006 after losing her former home to hurricane Katrina. Bourdon’s Covington home presents all the characteristics of tainted Chinese drywall, such as blackened silverware and mirrors, air conditioning failure, hot water tank split, problems with water faucets, as well as health issues like fatigue. Despite all those deficiencies, her insurance company still denied the claim.

While Bourdon is planning on ways to repair her house, she is forced to live in a trailer on her property.

Chinese Drywall Issues Cause More And More Homeowners To Be Concerned

Many Florida homeowners are becoming more concerned about the risks of having tainted Chinese drywall in their homes. With Chinese drywall incidents making headlines everyday, people are getting more suspicious. Most, however, do not exactly know how to detect bad drywall imported from China.

Ryan Wiggins, a spokeswoman for the Florida Attorney General’s Office, gives pointers on how to adequately detect affected Chinese drywall.

Informational Forum Held In Fort-Myers, Florida

An informational forum was held on Sunday in Fort Myers, Florida, where homeowners from the area were able to get more information about the Chinese Drywall issue that is causing problems in nearly 100,000 homes in the country.
Over a hundred people were present at the meeting to get some advice on how to detect tainted Chinese drywall in their homes. However, still many questions are left unanswered, as this issue is fairly recent.
Attorneys or environmental experts do not have all the answers regarding the difficulties people are facing. Many homeowners dealing with damage to their houses or health problems due to Chinse drywall do not always realize how slow and complicated the legal process is.

This is mainly due to the fact that solutions for fixing homes deteriorated by bad Chinese drywall are not yet fully developed, and the extent of
harm caused to people’s health is still unknown.

Potential Increase In Tainted Chinese Drywall Suppliers

More than 30 different variations of infected Chinese drywall were found in a new inspection carried out last Thursday, as lawyers involved in the litigation were asked to report all markings of manufacturers found in walls of tainted homes. This number, which is much higher than previously reported, may indicate an important increase in the number of tainted Chinese drywall manufacturers. They are responsible not only for shipping tainted drywall to the US, but also for corrosion and serious health problems for certain homeowners.

Test Results Show No Radiation Safety Risk In Homes Built With Chinese Drywall

According to the Consumer Product Safety Commission, people and families who live in houses built with Chinese drywall are not at risk of radiation. More than 20 samples from homes built with drywall were tested and results showed no radiation safety risk. The levels of radiation were almost identical to those from samples of brick and concrete.

New Proposed Law to make it easier to hold Chinese Companies Responsible for Defective Drywall

A new bill introduced into the US Senate will make it easier to hold Chinese companies accountable for defective drywall.  The bill calls for foreign companies to have a representative in the state where the companies do business that can accept service of lawsuits.   In addition, the bill requires foreign companies doing business in the US to consent to jurisdiction in this country if they are sued.  Read the full story here.

Chinese Drywall Cases Consolidated in New Orleans

All Chinese Drywall cases filed in federal court will be consolidated for pretrial proceedings in New Orleans.  The creation of a multi-district litigation panel or “MDL” is common in “mass tort” cases such as Chinese Drywall.  Judge Eldon E. Health Problems Caused By Radioactive Phosphogypsum

Even though experts haven’t completely determined the causes of health problems associated with tainted Chinese drywall, some have found that a radioactive substance called phosphogypsum is the source of those common health issues. This substance is not legal is the US, however manufacturers in China have been using it for a decade. About four Chinese companies have shipped drywall containing phosphogypsum to the US since 2006. Phosphogypsum is known to cause corrosion and thus foul odors in homes contaminated with it. As far as health issues, common problems for people who own a house built with tainted Chinese drywall include nosebleeds.
